1. Acceptance of Terms

By accessing or using Racquet-Hub.com ("the Platform"), operated by RacquetHub USA ("we," "us," or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Platform. Your continued use of the Platform constitutes your acceptance of these Terms and any updates thereto.

2. Description of Services

RacquetHub is an online marketplace and club management platform for racquet sports including Tennis, Pickleball, Padel, Badminton, Squash, and Table Tennis. Our services include but are not limited to:

Court discovery and booking
Player matching and game invitations
Trainer/coach discovery and scheduling
Club management tools for club owners
Payment processing for court bookings
Family account management

RacquetHub acts solely as an intermediary platform connecting players, clubs, and trainers. We do not own, operate, or manage any sports facility.

3. User Accounts

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account. Parents or legal guardians may create accounts for minors under 18 through the Family Account feature, and by doing so accept full responsibility for the minor's use of the Platform.

4. Assumption of Risk

YOU ACKNOWLEDGE THAT PARTICIPATION IN RACQUET SPORTS INVOLVES INHERENT RISKS OF PHYSICAL INJURY, INCLUDING BUT NOT LIMITED TO MUSCLE STRAINS, SPRAINS, FRACTURES, CONCUSSIONS, AND OTHER INJURIES. By using this Platform to book courts, find players, or participate in any sports activity, you voluntarily assume all risks associated with such activities.

You represent that you are physically fit to participate in racquet sports activities and have not been advised otherwise by a medical professional. If you have any medical conditions that may affect your ability to safely participate, you agree to consult a physician before engaging in any sports activities booked through this Platform.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RACQUETHUB USA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

Your use of or inability to use the Platform
Any physical injury, property damage, or death resulting from sports activities booked or arranged through the Platform
Any disputes between users, including players, club owners, and trainers
Any actions or omissions of clubs, facilities, trainers, or other users
Any errors, inaccuracies, or omissions in court listings, pricing, or availability
Any unauthorized access to your account or personal information
Any technical failures, system outages, or data loss

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

6. Waiver of Claims

BY USING THIS PLATFORM, YOU EXPRESSLY WAIVE AND RELEASE RACQUETHUB USA AND ITS AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR PARTICIPATION IN ANY SPORTS ACTIVITIES ARRANGED THROUGH THE PLATFORM.

This waiver applies to claims of any nature, whether known or unknown, suspected or unsuspected, and whether arising under contract, tort, strict liability, or any other legal theory.

7. Indemnification

You agree to indemnify, defend, and hold harmless RacquetHub USA and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of any third party.

8. Club & Facility Disclaimer

RacquetHub does not own, operate, inspect, or control any sports facility or club listed on the Platform. We make no representations or warranties regarding the safety, quality, legality, or suitability of any facility. Users are responsible for verifying the condition and safety of any court or facility before use.

9. Trainer Disclaimer

Trainers and coaches listed on the Platform are independent professionals, not employees or agents of RacquetHub. We do not verify their qualifications, certifications, or background. Users engage trainers at their own risk and should independently verify credentials before engaging in lessons or coaching sessions.

10. Payments & Refunds

All payments processed through the Platform are subject to our payment policies. Court booking fees are set by the respective clubs. RacquetHub may charge service fees for facilitating transactions. Refund policies are determined by individual clubs and are not guaranteed by RacquetHub. You agree to pay all charges incurred through your account.

11. Minor Users & Parental Consent

Minors under the age of 18 may only use the Platform through a Family Account managed by a parent or legal guardian. By adding a minor to your Family Account, you:

Represent that you are the parent or legal guardian of the minor
Accept these Terms on behalf of the minor
Assume all risks associated with the minor's participation in sports activities
Agree to supervise the minor's use of the Platform
Accept full financial responsibility for any charges incurred
Waive all claims on behalf of yourself and the minor against RacquetHub

12. User Conduct

You agree not to:

Use the Platform for any unlawful purpose
Harass, abuse, or threaten other users
Provide false or misleading information
Interfere with the Platform's operation or security
Create multiple accounts for fraudulent purposes
Scrape, copy, or redistribute content without permission

We reserve the right to suspend or terminate accounts that violate these Terms.

13. Privacy

Your privacy is important to us. By using the Platform, you consent to the collection, use, and sharing of your information as described in our practices. We collect personal information including name, email, phone number, location data, and sports preferences to provide our services. We do not sell your personal information to third parties.

14. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or the use of the Platform shall be resolved through binding arbitration in the State of New Jersey, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits. Each party shall bear its own costs and attorneys' fees.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

16. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after any modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
